HON SOB AGUNBIADE (MAJORITY LEADER ) MOVED A MOTION, ON NEED TO WALL-OFF MILE 12 MARKET FROM THE EXPRESS ROAD.AMONG OTHER MOTIONS AND THE HOUSE RESOLUTIONS


Need To Wall-off Mile 12 Market from the Express Road

“This House:

Notes the effort of the Government of Lagos State in easing vehicular movements and reducing man-hour loss during traffic lock-jam, consequent upon which the Government has embarked on reconstruction and rehabilitation of roads in the State;   

Further notes that the Mile 12-Ikorodu road is one of the busiest roads in the State, with record of critical traffic lock jam, normally around Mile 12-Ketu axis

Is concerned that despite the huge investments on the road by the Lagos State Government, the intendment of the Government to eliminate traffic gridlock is still being sabotaged by motorists who either park to pick or off-load passengers along Ikorodu road (especially Mile-12 market axis); and

Is worried that unless the Government takes urgent steps that would prevent the commercial activities in the Mile 12 market from interfering with smooth vehicular movement around the Mile 12 market, either by relocating the market or fencing it off from the road, the huge investment of Lagos State Government on the Mile 12-Ikorodu road will not be impactful.”


Resolves to:

Call on His Excellency, the Governor of Lagos State, Mr. Akinwunmi Ambode to take an urgent and bold step in building a strong-wall fence along the Mile 12 market towards Ketu axis with the intent of diverting the exit from and entry into the market away from the express road ; and

Empowering the opinion leaders in the Local Government playing host to the regional market to commence enlightenment consultation process with the leadership of Mile 12 market with a view to achieving a better understanding to this wall-off-initiative.


 Improving Security Measures on Lagos Waterways

“This House:

Notes the spate of bank robbery operations in Lagos State with the attendant loss of lives and property;

Further notes that armed robbers have adopted the waterways as escape routes after operations and this portends danger to innocent people in aquatic business and those that have embraced water transportation;

Is aware that Section 5 (s) of the Lagos State Waterways Authority Law, 2008 states inter alia:

‘Establish by regulation with the approval of the House of Assembly, a State Waterways Guard Corps to patrol, superintend, secure, and regulate traffic, safety and compliance with this law on and around the State internal waterways’; and

Is concerned that despite the establishment of the State Waterways Guard Corps, men of the underworld have continued to perpetrate their activities through the Waterways and unless they are secured with operational equipment, the water transportation business will be adversely affected and the huge investment of the State Government in fighting crime will be of little impact.”

Resolves to:

Call on His Excellency, the President of the Federal Republic of Nigeria, Muhammadu Buhari to direct the Nigerian Navy and other relevant Agencies to address the security challenges on the waterways in the State;

Call on His Excellency, the Governor of Lagos State, Mr. Akinwunmi Ambode to strengthen the Lagos State Waterways Guard Corps with functional operational equipment that will enable the Authority perform its  functions as provided for in Section 5 (s) of the Lagos State Waterways Authority Law, 2008; and direct the appropriate Agency to ensure that the two helicopters purchased by the State Government are strictly used for surveillance and made available promptly for emergency operations whenever the need arises; and

Urge commercial banks within the State to as a matter of urgency strengthen their security strategies by installing high powered security cameras in and around the banking halls. 


Call for the Dissolution of Membership of Lagos State Judicial Service Commission

“This House:

Notes Section 197 (1) (c) of the 1999 Constitution of the Federal Republic of Nigeria (as amended) states inter alia:

‘there shall be established for each State of the Federation, State Judicial Service Commission’.

Further notes that the Lagos State Judicial Service Commission sees to the appointment, promotion, discipline, control of all Staff, recommendation to the National Judicial Council nomination of persons suitable for the Office of Chief Judge and Judges of the High Court, removal from Office of any Judicial Officer found wanting in the discharge of his duties and general welfare of Judges in the State;

Observes that the current Membership of the Lagos State Judicial Service Commission was confirmed by the Lagos State House of Assembly at the Plenary Session of Thursday, 25th February, 2010;

Further observes that Section 199 (1) (c) of the 1999 Constitution of the Federal Republic of Nigeria (as amended) approves a five (5) year tenure for Chairman and Members of Judicial Service Commission from the date of their appointments; and

Is aware that the Chairman and Members are still in Office despite the expiration of their tenure since February, 2015.”

Resolves to:
Call on His Excellency, the Governor of Lagos State, Mr. Akinwunmi Ambode to dissolve the current Membership of the Lagos State Judicial Service Commission to give effect to the expiration of their five (5) year tenure as stipulated in the Constitution.


Call for Amendment of Lagos State University Law and Resolving the  Perennial Crises

“This House:

Notes that Section 3 (f) and (g) of the Lagos State University Law, 2004 state the objectives of the institution to include:

Encourage the advancement of the learning and to provide the opportunity for acquiring higher and liberal education; and
Act as a vehicle of development in general and in particular as an instrument that will effectively stimulate the development of the state through continuing education, applied research, technical assistance, direct consultation, informational services, internship program and student industrial work experiences scheme.

Further notes that Schedule 1, Sub 3(3) of the enabling law provides for two (2) terms tenure of four (4) years each for the Vice Chancellor, who is vested with the responsibility of maintaining and promoting efficiency as well as good order of the University;

Observes that since the establishment of the University, it has been bedeviled with internal crises and more often targeted at the incumbent Vice Chancellor aspiration for a second tenure;

Further observes that in the history of the University, almost all the Vice Chancellors ended their tenures in serious crises occasioned by aspiration for two (2) term tenure and leaving the office unceremoniously;

Also aware that Section 40 of the enabling law reversed the non-residential policy of the State University to a residential as far as practicable and made provision of residence mandatory for medical students in their clinical years;


Is worried that the incessant crises in the University have affected the image, development and standard of education are robbing off on the aim and objectives of establishing the university by the Lagos State Government; and

Is concerned that some Faculties that have brought honour, pride and recognition to the citadel of learning are now either losing the accreditation or remain not accredited.”

Resolves to:

A (i) Cause the amendment to the Lagos State University Law, 2004 to grant Office of the Vice Chancellor of Lagos State University a single tenure of five (5) years which is the current practice in most Universities in the country; and

(ii) Organize an urgent stakeholders’ meeting, involving all segment of the university to discuss the prevailing problems of the university and in particular factors affecting accreditations of courses in the university to be able to advice the Governor on ways of achieving enduring solutions to the hydra headed problems of the university.

B. Call on His Excellency, the Governor of Lagos State, Mr. Akinwunmi Ambode to:
(i) Set in motion machinery of government that will give a more serious effect to residential policy of the Government in respect of the University as provided in Section 40 of the Lagos State University Law, 2004; and
(ii) Set up the Governing Council of the Lagos State University and the Lagos State Polytechnic as prescribed in the extant Laws establishing the Institutions.

Call for Urgent Investigation into the Activities and Funding of the Federal Road Maintenance Agency (FERMA) in Respect of Federal Roads in Lagos State in the Last Eight Years

“This House:

Notes that the Lagos State Government has in the last two (2) months, through the Lagos State Public Works Corporation carried out several degrees of rehabilitation activities on seventeen (17) Federal roads, in Lagos State, namely:

1.       Lagos –Abeokuta Expressway, Mongoro-Cement-Dopemu under bridge Axis;
2.       Mile 2 interchange;
3.       Epe –Ijebu Ode Road, Odomola- Poka/College Road Junction Axis;
4.       Ahmadu Bello Way, Galleria (Silverbird) axis inward Bonny Camp, Victoria Island;
5.       Ikorodu Road, Ojota axis, service lane by TOTAL outward Motorway, Ikeja LG;
6.       Mobolaji Bank Anthony Way, Sheraton –NITEL axis inward Maryland, Ikeja;
7.       Lagos-Abeokuta Expressway, Cement-Ile Zik Axis inward Ikeja;
8.       Ikorodu Road, Mile 12-Ketu Axis;
9.       Third Mainland Bridge exit inward Onikan;
10.    Agege Motor Road, Regina Mundi Axis, Oloosa;
11.    Apapa –Oshodi Expressway, Toyota-charity axis by LAWMA Transfer Station;
12.    Ikorodu Road, Anthony-Obanikoro Service Lane; Apapa-Oworonsoki Expressway, Anthony Bridge Approach behind LSDPC Outward   Town Planning Way;
13.    Agege-Motor Road, Oshodi underpass-Cappa Axis;
14.    Lagos-Abeokuta Expressway, Pako-Adealu Axis by Alimosho Road;
15.    Ikorodu-Sagamu Road (Oriwu Club-LASPOTECH Gate Axis); and
16.    Herbert Macaulay Way, Jibowu-Harvey Junction Axis.

Further notes that it is the Federal Road Maintenance Agency (FERMA), an agency of the Federal Government of Nigeria, which has annual budgetary allocation to maintain and rehabilitate Federal Roads that should perform this function in each State of the Federation;
Discovers through investigation, that on two occasions, the Lagos State Public Works Corporation attempted to rehabilitate two other Federal Roads on Ahmadu Bello Way and Mile 2 interchange, the Corporation was prevented from embarking on the rehabilitation by the FERMA on claim that the roads are Federal roads under its purview;

Is aware that the statutory functions of the Lagos State Public Works Corporation and the State annual appropriation for the Corporation does not cover Federal roads;

Is further aware, that the Lagos State Public Works Corporation extends its maintenance activities to cover those Federal roads earlier mentioned, because FERMA in the State abdicated its responsibilities on these roads like some other Federal roads and an average citizen of Nigeria is concerned about good roads and not which tier of government is responsible to fix the road;

Is worried that the State funds spent on these Federal roads already captured in the Federal Government appropriation for its Agency (FERMA), is inimical to the condition of some State roads begging for attention and requiring State funding; and

Is concerned that unless the Federal Government urgently investigates the adequacy or otherwise of its appropriation to FERMA in respect of Federal roads in Lagos State  towards the next fiscal year, the responsibility of Lagos State to its citizens in respect of roads will continue to be hindered and the State short-changed the more.”

Resolves to:
Commend His Excellency, the Governor of the State, Mr. Akinwunmi Ambode, for his commitment to infrastructural upgrade in the State since he assumed office few months ago;

Call on His Excellency, the Governor of the State, Mr. Akinwunmi Ambode, to demand for reimbursement or refund, from the Federal Government of Nigeria, all the monies expended by Lagos State on all the Federal roads so far rehabilitated and which monies are yet to be refunded to the State;

Call on the President of the Federal Republic of Nigeria, His Excellency, Muhammadu Buhari, GCFR to call for urgent investigation into to the activities and funding of the Federal Road Maintenance Agency (FERMA) in Lagos State in the last eight years;

Call on the Lagos State Caucus at the National Assembly to commence mobilization both at the upper and lower Chambers, for the request of Lagos State to be granted the special status it deserves with all the benefits, as a former Federal Capital and current economic nerve centre of the Federal Republic of Nigeria;

Call on the State Ministry of Economic Planning and Budget to grant more financial leverage to the Lagos State Public Works Corporation through appropriation in the coming fiscal year, to enable it fulfil its responsibilities in respect of roads maintenance in the State.


Call for Constituency Stakeholders’ Meeting

“This House:    

Notes that one of the primary responsibilities of the Legislature is to represent the interests and aspirations of its various constituents and make laws for the good government of the State;  
                                   
Further notes that sequel to the constitutional responsibilities of the Legislature as stated above, it is imperative that Members of the Legislature interact with constituents to know their needs and ventilate same for government attention and actions;   
                                                                                                    
Realizes that a large number of members of the public does not know the specific functions of the Legislature and as such often erroneously make demands on Members of the Legislature to perform the functions of the Executive Arm;   
                                                     
Further realizes the urgent need to commence public enlightenment programme that will educate the public on the duties and constitutional limitations of the Legislature as well as making adequate and best use of the elected representatives in each of the Constituencies; and 

Is aware that a better constituency engagement could be achieved when some days are set aside for the Member of the  House of Assembly to interact with constituencies  simultaneously throughout the State, to enlighten members of the public on the structure of Government, duties of the respective Arms of Government,   explain Government Policies , receive   criticisms, complaints and suggestions from the Constituents,  investigate, gather and collate the peculiar needs of the people to enable the government process and attend to constituency needs
                                                                      
Resolves:

To hold Constituency Stakeholders' Meeting in each of the forty (40) Constituencies of the State, simultaneously on Tuesday, 10th of November, 2015;     
                               
That the Constituency Stakeholders' Meeting will be for a cross section of interest groups in each of the constituencies of the State to achieve the desired objectives of this Constituency engagement initiative; 
                                                
That additional two days of Wednesday, 11th and Thursday, 12th November, 2015 be set aside to enable constituents submit  to the Desk Officers at the venue of the Stakeholders’ Meeting; and
                                      
That the outcome of the  Constituency Stakeholders' Meeting be collated and process by the Leadership of the House of Assembly as the needs assessment of the forty (40) Constituencies of the State for onward transmission to the Executive Arm for necessary action.
